1. About these terms
This website is operated by Productized Media, Cherry Tree Court, Cross Street, Leek, Staffordshire, ST13 6BL, United Kingdom. Contact [email protected] for questions, support or complaints.
These terms govern use of productizedmedia.com and provide general information about our offers. Read them before using the website. Our Privacy Policy explains how personal information is handled.
2. Publisher partnerships: your signed agreement governs
Any arrangement to fund, install or run product offers on a publisher’s website is governed by a separate written agreement signed by the parties. That agreement sets the revenue split, calculation of revenue, payment schedule, costs and deductions if any, refunds and chargebacks, access permissions, responsibilities, duration and termination rights.
If these website terms conflict with your signed publisher agreement, the signed agreement takes priority for that partnership, subject to mandatory law. Submitting an enquiry does not create a partnership, authorise website changes or commit either party to proceed. We do not obtain ownership of your blog merely because you contact us.
The website’s “you pay us nothing” statements describe our publisher revenue-share model. They do not mean that products sold to customers are free. Any commercial arrangement and its full terms must be agreed before work begins.
3. Revenue and performance
Product sales depend on the audience, traffic, offer, pricing, demand and other factors. Revenue figures and “up to” comparisons describe potential outcomes or aims, not a promise of earnings. There is no guaranteed level of sales, income or increase in the value of a website.
Any payment to a publisher is determined by the revenue and payment provisions in the signed agreement. A 30-day evaluation does not guarantee a payment amount or create a subscription fee at its end.
4. Products and offers
We may create, license, source, promote or sell products ourselves, and we may promote products sold by third parties. The offer or checkout identifies the seller and the terms applying to a purchase. Where you buy directly from another seller, your purchase contract is with that seller.
Where Productized Media is the seller, the product description and purchase terms provided before you order form part of your purchase agreement. They explain what is included, the price and currency, applicable taxes and charges, delivery or access arrangements, and any product-specific conditions. We provide confirmation of an accepted order in a form you can keep.
We may receive commission or a share of revenue from offers we promote. Any required commercial or affiliate disclosure will be provided with the relevant offer.
5. Payments through Stripe
Payments for products sold by us may be processed through Stripe. You must provide accurate billing information and be authorised to use the payment method. The total amount and currency are shown before you confirm payment. A payment may be declined or require authentication or fraud checks.
Stripe provides payment services; using Stripe does not make it the seller of our products or responsible for their fulfilment. Contact [email protected] about an order, payment problem or refund involving a product we sell. Stripe’s handling of payment information is described in its Privacy Policy and our payment privacy information.
Payment details are entered through Stripe’s payment interface. Do not send full card details or security codes by email or through our enquiry form.
6. Subscriptions and recurring charges
A recurring payment applies only when it is clearly disclosed and you agree to it at checkout. The offer must state the amount, billing frequency, any minimum term, renewal arrangements, and how to cancel. Any trial conversion or introductory price must be explained before you subscribe.
You can cancel using the method supplied with your subscription or by contacting [email protected]. Applicable cancellation rights and mandatory notices are preserved. Publisher revenue-share arrangements are governed by the signed publisher agreement, not by these customer subscription provisions.
7. Refunds, cancellations and consumer rights
The offer and checkout set out any additional refund policy, delivery terms and cancellation instructions for the specific product. Nothing in these terms removes rights relating to faulty, misdescribed or undelivered products, or any other rights that cannot lawfully be excluded.
UK consumers buying at a distance generally have a 14-day cancellation period, subject to statutory exceptions. For goods, it normally runs from the day after receipt; for services and digital content, from the day after the contract is made.
Immediate supply of digital content only removes the statutory change-of-mind right where the required express consent and acknowledgement have been obtained and the legal conditions are met. Agreeing to these website terms alone does not waive that right. If you ask for a service to start during a cancellation period, any proportionate charge or loss of a cancellation right must meet the applicable legal conditions.
To cancel or request help, email [email protected] with your name, order reference, purchase date and a clear explanation of what you want to cancel or what went wrong. You may also write to our address above. A clear cancellation statement is sufficient; you do not have to use particular wording.
Refunds that are due are made within the legally required period, normally to the original payment method. Where the law allows a goods refund to be withheld pending return or proof of return, we will explain that. Applicable rights in your country, including mandatory California or EU consumer protections, are not waived.
8. Using the website
Provide accurate information and use the site lawfully. Do not upload malicious material, interfere with security, impersonate someone, misuse the enquiry form, attempt unauthorised access, or infringe another person’s rights. Do not send confidential material you are not authorised to share.
We may restrict access where reasonably necessary to protect the site, comply with law or address misuse. We aim to keep information accurate and the site available, but may change, suspend or correct website content. This does not alter an existing signed agreement or accepted order.
9. Content and third-party links
Our branding, text, designs and other website materials belong to us or our licensors. You may view and make reasonable copies for evaluating our services. You may not reproduce them commercially, imply our endorsement or use our branding without permission, unless the law permits it.
Links to external sites are provided for convenience. Their operators control their content, terms and privacy practices. This does not reduce our responsibilities where we are the seller or otherwise legally responsible for an offer.
10. Responsibility and limits
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
For business users, to the extent the law permits and unless a signed agreement says otherwise, we are not liable for indirect or consequential losses arising from use of this informational website, including lost business opportunities. Liability relating to a publisher partnership is governed by its signed agreement.
If you are a consumer, mandatory rights and remedies remain unaffected. We remain responsible for losses for which the law makes us responsible; these website terms do not impose a blanket exclusion of liability for products we sell.
11. Applicable law and disputes
These website terms are governed by the law of England and Wales. For business disputes concerning these website terms, the courts of England and Wales have exclusive jurisdiction, unless a signed agreement provides otherwise.
If you are a consumer, this does not deprive you of mandatory protections or the right to bring proceedings in a court available to you under applicable law, including in your country of residence where required. Please contact [email protected] so we can try to resolve a concern.
12. Changes and general provisions
We may revise these website terms prospectively; the current version and date are displayed here. Changes do not retrospectively change an accepted order or a signed publisher agreement. Those arrangements can only be changed in accordance with their own terms and applicable law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a right does not waive it. These terms do not grant a third party enforcement rights except where the law requires otherwise.
